本《D5渲染器用户协议》（“本专项条款”）是《D5服务通用条款》（“通用条款”）的补充，与通用条款具有同等法律效力。如本专项条款与通用条款存在不一致或冲突，以本专项条款为准；本专项条款未约定事项，适用通用条款。

This D5 Render User Agreement (the "Special Terms") supplements the D5 General Terms of Service (the "General Terms") and has the same legal effect as the General Terms. In the event of any inconsistency or conflict between these Special Terms and the General Terms, these Special Terms shall prevail. Matters not covered by these Special Terms shall be governed by the General Terms.

一、适用范围 Scope of Application

1. 本专项条款适用于您在中国大陆环境下安装、访问和使用的D5渲染器软件及其相关功能，包括但不限于：本地渲染、实时联动、场景处理、素材库、AI 相关功能等。

1. These Special Terms apply to your installation of, access to, and use of the D5 Render software and its related features in the mainland China environment, including without limitation local rendering, real-time synchronization, scene processing, asset library, AI-related features, and other functions.

如您的主要居住地、注册地、营业地或通常使用地不在中国大陆，但您主动或自愿选择安装、访问或使用中国大陆版本的 D5 渲染器软件，本专项条款将作为中国大陆版本 D5 渲染器软件的专项条款适用于您的相关使用；有关中国大陆版本服务适用条款、法律适用、本地合规及版本差异的说明，以通用条款相关约定为准。

If your primary residence, place of registration, place of business, or usual place of use is not in mainland China, but you actively or voluntarily choose to install, access, or use the mainland China version of the D5 Render software, these Special Terms shall apply to your relevant use as the Special Terms for the mainland China version of the D5 Render software. The applicable terms, governing law, local compliance requirements, and version differences relating to the mainland China version of the Services shall be subject to the relevant provisions of the General Terms.

2. 如您仅浏览或使用 D5 官网、论坛、活动页面等，而未安装或使用 D5 渲染器软件，则本专项条款一般不适用，但您仍应遵守通用条款以及网站上其他适用的规则/政策。

3. If you only browse or use the D5 official website, forums, event pages, or similar services, and do not install or use the D5 Render software, these Special Terms generally do not apply. However, you shall still comply with the General Terms and any other applicable rules/policies on the website.

二、D5渲染器软件许可 D5 Render Software License

1. 在您遵守通用条款和本专项条款前提下，D5向您授予一项非排他性、非永久性、不可转让、不可再许可、可撤销的有限许可，允许您在授权范围内安装和使用D5渲染器软件。具体许可类型（如个人专业版、团队版、学生版等）以及使用期限、授权数量等，以您购买时的页面展示、订单信息或您与 D5 另行签署的协议为准。

1. Subject to your compliance with the General Terms and these Special Terms, D5 grants you a non-exclusive, non-perpetual, non-transferable, non-sublicensable, revocable limited license to install and use the D5 Render software within the authorized scope. The specific license type, such as Individual Pro, Team, Student, or other license types, as well as the term of use, number of authorized seats, and other licensing details, shall be subject to the page display at the time of purchase, your order information, or any agreement separately executed between you and D5.

2. 除法律明文允许或D5事先书面同意外，您不得对D5渲染器进行下列行为：

2. Unless expressly permitted by law or with D5's prior written consent, you shall not conduct any of the following acts with respect to D5 Render:

（1）复制、修改、合并、翻译、改编 D5渲染器或其任何部分；

(1) copy, modify, merge, translate, or adapt D5 Render or any part thereof;

（2）对D5渲染器进行反向工程、反编译、反汇编、解码，或以其他方式尝试获取源代码（法律强制允许的除外）；

(2) reverse engineer, decompile, disassemble, decode, or otherwise attempt to obtain the source code of D5 Render, except where mandatorily permitted by law;

（3）移除、篡改或遮挡D5或其许可方的任何权利声明、标识、商标或其他权利标识；

(3) remove, tamper with, or obscure any rights notice, logo, trademark, or other proprietary designation of D5 or its licensors;

（4）将D5渲染器出租、出借、出售、转让、分许可、通过拼单等方式提供给任何第三方使用；

(4) rent, lend, sell, transfer, sublicense, or otherwise make D5 Render available to any third party, including by group purchasing or similar arrangements;

（5）利用任何自动化方式（包括脚本、机器人等）批量调用或滥用 D5 渲染器资源，或以其他方式绕过/规避授权数量、设备绑定、并发数量等技术或商业限制。

(5) use any automated means, including scripts, bots, or similar tools, to make bulk calls to or abuse D5 Render resources, or otherwise bypass or circumvent technical or commercial restrictions such as authorized seat limits, device binding restrictions, or concurrent use limits.

3. D5 有权基于版本更新、功能优化或合规要求，对 D5 渲染器进行更新、升级或调整，并有权要求您安装相应更新版本方可继续使用。您理解并同意，某些更新可能是维持安全性或合规性所必需，如您拒绝更新，D5 有权限制或中止向您提供部分或全部功能。

3. D5 has the right to update, upgrade, or adjust D5 Render based on version updates, feature optimization, or compliance requirements, and has the right to require you to install the corresponding updated version in order to continue using it. You understand and agree that certain updates may be necessary to maintain security or compliance. If you refuse to install such updates, D5 has the right to restrict or suspend the provision of some or all features to you.

三、内容及素材库使用 Use of Content and Asset Library

1."内容"定义 Definition of "Content"

在本专项条款中，“内容”包括：

For purposes of these Special Terms, "Content" includes:

（1）您在使用D5渲染器过程中导入、上传或以其他方式提供的文本、文件、模型、贴图、材质、音频、视频、图像、场景等（统称为“输入内容”）；

(1) any text, files, models, textures, materials, audio, video, images, scenes, and similar materials that you import, upload, or otherwise provide in the course of using D5 Render, collectively, "Input Content"; and

（2）您使用 D5 渲染器生成的渲染结果、动画、场景文件、预设、全景图像或其他输出成果（统称为“输出内容”）。

(2) any rendered results, animations, scene files, presets, panoramic images, or other outputs that you generate using D5 Render, collectively, "Output Content".

2. 您的权利 Your Rights

As between you and D5, and to the maximum extent permitted by law, you retain all rights in and to rendered results and other Content generated by you using D5 Render based on your own lawful materials, subject to the General Terms, these Special Terms, and any applicable third-party license terms. D5 does not claim any ownership of your Content, but you shall ensure that your Content is lawfully sourced and used in compliance with applicable requirements.

3. 第三方软件输出责任 Responsibility for Outputs from Third-Party Software

如您在 D5 渲染器中使用来自第三方软件（包括但不限于 Autodesk® 产品（如 Revit®）、SketchUp、3ds Max、Revit、Rhino 等）的文件、模型或其他输出，您应自行确保：

If you use, in D5 Render, any files, models, or other outputs from third-party software, including without limitation Autodesk® products such as Revit®, SketchUp, 3ds Max, Revit, Rhino, and similar software, you shall be solely responsible for ensuring that:

（1）该等使用行为符合相关第三方软件的许可条款、可接受使用政策以及其他合同或法律义务；

(1) such use complies with the license terms, acceptable use policies, and other contractual or legal obligations applicable to the relevant third-party software; and

（2）您已取得在 D5 渲染器中导入、处理、渲染和展示该等内容所必需的一切权利和授权。

(2) you have obtained all rights and authorizations necessary to import, process, render, and display such Content in D5 Render.

D5 并不监控或核实您内容的来源，也不对因您违反第三方软件许可条款或其他义务所导致的任何纠纷、索赔或监管风险承担责任。对于因此引发的任何第三方索赔、损失、罚款或争议，您应自行承担全部责任，并就此使 D5 免责并进行赔偿。

D5 does not monitor or verify the source of your Content, and shall not be liable for any disputes, claims, or regulatory risks arising from your violation of third-party software license terms or other obligations. You shall be solely responsible for any third-party claims, losses, fines, or disputes arising therefrom, and shall indemnify and hold D5 harmless in connection therewith.

4. 素材库授权与使用限制 Asset Library License and Use Restrictions

4.1 D5 在 D5 渲染器中向您提供一定范围的数字素材库（“素材库”），包括模型、贴图、材质、HDR、粒子、预设等。素材库中的部分素材可能在界面中标注为“个人许可（Personal License）”或“项目许可（Project License）”。您对该等素材的使用范围，以相应标注为准：

4.1 D5 provides you with access to a certain range of digital asset libraries in D5 Render, including models, textures, materials, HDRs, particles, presets, and similar materials, the "Asset Library". Certain assets in the Asset Library may be marked in the interface as subject to a "Personal License" or "Project License". Your scope of use of such assets shall be subject to the corresponding label.

4.2"个人许可"的素材 Assets under "Personal License"

对于在素材库或相关页面中标注为“个人许可”的素材，在您遵守通用条款和本专项条款的前提下：

For assets marked as subject to a "Personal License" in the Asset Library or on relevant pages, subject to your compliance with the General Terms and these Special Terms:

（1）您获授一项非排他、不可转让、不可再许可、免版税、全球范围、可撤销的许可，仅用于您的个人、内部、非商业目的；

(1) you are granted a non-exclusive, non-transferable, non-sublicensable, royalty-free, worldwide, revocable license solely for your personal, internal, and non-commercial purposes;

（2）您不得：

(2) you shall not:

将此类素材用于任何商业项目、付费项目、对外客户交付或促销活动；

use such assets in any commercial project, paid project, deliverable to external clients, or promotional activity; or

将此类素材或基于该素材仅作轻微修改的成果单独出售、授权或再分发，或以其他方式进行商业性利用。

sell, license, redistribute, or otherwise commercially exploit such assets, or any results based on such assets with only minor modifications, on a standalone basis.

4.3"项目许可"的素材 Assets under "Project License"

对于标注为“项目许可”的素材，在您遵守通用条款和本专项条款的前提下：

For assets marked as subject to a "Project License", subject to your compliance with the General Terms and these Special Terms:

（1）您获授一项非排他、不可转让、不可再许可、免版税、全球范围、可撤销的许可，可以下载、复制、修改、展示、分发并将该等素材嵌入到您的商业项目之中，包括向客户交付的成果、宣传材料、付费项目及其他可实现收益的项目；

(1) you are granted a non-exclusive, non-transferable, non-sublicensable, royalty-free, worldwide, revocable license to download, copy, modify, display, distribute, and embed such assets into your commercial projects, including deliverables to clients, promotional materials, paid projects, and other revenue-generating projects;

（2）该许可并不允许您：

(2) such license does not permit you to:

将此类素材以独立文件形式进行转售或再分发；

resell or redistribute such assets as standalone files;

宣称对素材本身享有所有权；

claim ownership of the assets themselves; or

以与素材本身授权相竞争的方式向第三方再许可该等素材（但在将最终项目成果交付客户时，基于项目交付所必需的隐含再许可除外）。

sublicense such assets to any third party in a manner that competes with the license for the assets themselves, except for any implied sublicense necessary for project delivery when final project deliverables are provided to clients.

4.4 使用责任和合规要求 Use Responsibilities and Compliance Requirements

（1）您应自行负责识别并遵守每一素材对应的使用范围，不得删除、修改或遮挡任何与许可范围相关的标注、文件名、标签或元数据；

(1) You shall be solely responsible for identifying and complying with the scope of use applicable to each asset, and shall not remove, modify, or obscure any labels, file names, tags, or metadata relating to the scope of license.

（2）如您在同一项目中混用“个人许可”素材和“项目许可”素材，则在未获得额外授权的前提下，该项目整体应视为非商业用途；

(2) If you combine assets under "Personal License" and assets under "Project License" in the same project, then, unless additional authorization has been obtained, the entire project shall be deemed to be for non-commercial use.

（3）如您超出素材标签允许的范围使用素材（例如将“个人许可”素材用于商业项目，或单独转售“项目许可”素材本身），因此产生的全部责任、争议、赔偿及监管风险，由您自行承担，D5 对此不承担任何责任；

(3) If you use any asset beyond the scope permitted by the asset label, for example, by using an asset under "Personal License" in a commercial project, or by reselling an asset under "Project License" itself on a standalone basis, you shall be solely responsible for all liabilities, disputes, compensation, and regulatory risks arising therefrom, and D5 shall not be liable in this regard.

（4）为保障素材库的公平、合理使用，D5 有权在不直接访问您的具体作品内容的前提下，基于账户层面或使用模式进行合规性审查。如发现明显超出许可范围或存在滥用行为的，D5 有权依据通用条款及本专项条款采取包括但不限于提示整改、限制功能、终止服务在内的措施。

(4) To ensure fair and reasonable use of the Asset Library, D5 has the right to conduct compliance reviews based on account-level information or usage patterns, without directly accessing the specific contents of your works. If any use clearly exceeds the permitted scope of license or constitutes abuse, D5 shall have the right to take measures in accordance with the General Terms and these Special Terms, including without limitation requiring rectification, restricting functions, or terminating the Services.

4.5 权利保留及违约责任 Reservation of Rights and Breach Liability

（1）除本条明确授予您的权利外，素材库及其中素材的全部权利、所有权和利益均归 D5 或其相应权利人享有，您对素材库不享有任何所有权；

(1) Except for the rights expressly granted to you under this Section, all rights, title, and interest in and to the Asset Library and the assets therein are owned by D5 or the relevant rights holders. You do not acquire any ownership of the Asset Library.

（2）任何超出许可范围的使用均构成对本专项条款的违约。对因您未经授权或超范围使用素材而产生的任何第三方索赔、损失、罚款或争议，您应自行承担全部责任，并在法律允许的最大范围内，赔偿并使 D5 及其关联公司、许可方和合作伙伴免受损害。

(2) Any use beyond the permitted scope of license shall constitute a breach of these Special Terms. You shall be solely responsible for any third-party claims, losses, fines, or disputes arising from your unauthorized use of assets or use beyond the permitted scope, and, to the maximum extent permitted by law, shall indemnify and hold harmless D5, its affiliates, licensors, and partners from and against the same.

5. 用户责任 User Responsibility

您应保证您在D5渲染器中使用的全部内容及素材均具有合法来源，不侵犯任何第三方的著作权、商标权、肖像权、隐私权或其他合法权利。如因您的内容或使用行为引发第三方索赔、争议、诉讼或行政处罚，您应独立承担全部责任，并赔偿D5因此遭受的全部损失（包括但不限于合理律师费、诉讼费、公证费等）。

You shall ensure that all Content and assets used by you in D5 Render are lawfully sourced and do not infringe any third party's copyright, trademark rights, portrait rights, privacy rights, or other lawful rights. If any third-party claim, dispute, lawsuit, or administrative penalty arises from your Content or use, you shall independently bear all responsibility and compensate D5 for all losses suffered thereby, including without limitation reasonable attorneys' fees, litigation fees, notarization fees, and similar costs.

6. 用户授予许可 License Granted by User

当您使用 D5 渲染器时，在法律允许的最大范围内，您授予 D5 一项非独占的、全球范围内的、免版税的、已完全付费的、可转让的且可再许可的（仅限于 D5 的关联方）许可，以对您的内容进行以下处理：

When you use D5 Render, to the maximum extent permitted by law, you grant D5 a non-exclusive, worldwide, royalty-free, fully paid, transferable, and sublicensable license, sublicensable only to D5's affiliates, to process your Content as follows:

（a）按照您的指示，由 D5 及/或其关联方、供应商及合作伙伴使用 D5 渲染器对您的内容进行处理；

(a) to process your Content using D5 Render in accordance with your instructions, by D5 and/or its affiliates, suppliers, and partners;

（b）在 D5 的服务器上存储您的内容副本，以支持内容上传及备份；

(b) to store copies of your Content on D5's servers to support content upload and backup;

（c）仅在您的账户或设备内向您本人展示您的内容，除非您另行明确授权，否则不会向公众或其他用户展示；

(c) to display your Content only to you within your account or device, and not to display it to the public or other users unless you have separately given express authorization;

（d）对您的内容进行必要的修改或技术性处理，例如生成图像缩略图、将内容转换为其他格式；

(d) to make necessary modifications or technical processing to your Content, such as generating image thumbnails or converting Content into other formats; and

（e）在提供 AI 功能服务（包括但不限于翻译、三维生成、贴图生成等）所必需的范围内，将您的内容（如文本、图像等）提供给 D5 及/或其关联方、供应商及合作伙伴。D5将根据其与该等供应商或合作伙伴之间届时适用的合作协议、服务条款、数据处理条款、公开政策或其他可获得的合规说明，采取合理商业措施选择、接入和管理相关供应商或合作伙伴，并通过适用安排约定或确认其处理目的、处理范围及相关使用限制，以使其对相关内容的处理限于为 D5 提供相关 AI 功能所合理必要的范围，且不应将相关内容用于其自有模型训练、营销、广告、公开展示、转售或与 D5 服务无关的独立用途。除法律法规另有规定或 D5 另有明确承诺外，D5不对该等供应商或合作伙伴的服务、系统、政策、实际处理行为或持续可用性作出独立保证。

(e) to provide your Content, such as text and images, to D5 and/or its affiliates, suppliers, and partners to the extent necessary to provide AI feature services, including without limitation translation, 3D generation, texture generation, and similar services. D5 will take commercially reasonable measures to select, integrate, and manage the relevant suppliers or partners based on the cooperation agreements, service terms, data processing terms, public policies, or other available compliance descriptions then applicable between D5 and such suppliers or partners, and will agree on or confirm, through applicable arrangements, their processing purposes, processing scope, and relevant use restrictions, so that their processing of the relevant Content is limited to the scope reasonably necessary to provide the relevant AI features for D5, and such Content shall not be used for their own model training, marketing, advertising, public display, resale, or independent purposes unrelated to the D5 Services. Unless otherwise required by laws and regulations or expressly undertaken by D5, D5 does not make any independent warranty regarding the services, systems, policies, actual processing activities, or continued availability of such suppliers or partners.

7. 许可期限 License Term

除法律另有规定或为解决争议所必需外，本条所授予的许可，在本专项条款及相关账号终止后三十（30）天内自动终止。

Unless otherwise provided by law or necessary for dispute resolution, the license granted under this Section shall automatically terminate within thirty (30) days after the termination of these Special Terms and the relevant account.

8. 营销使用需另行授权 Separate Authorization Required for Marketing Use

如D5希望在营销或宣传中使用您的渲染成果（例如在官网或社交媒体展示您的作品），将会事先与您单独沟通并取得您的明确授权。

If D5 wishes to use your rendered results for marketing or promotional purposes, for example, by displaying your works on its official website or social media, D5 will communicate with you separately in advance and obtain your express authorization.

四、D5渲染器中对您内容的处理及AI 功能 Processing of Your Content in D5 Render and AI Features

1. 不用于训练的承诺 Commitment Not to Use for Training

未经您明确的书面同意，D5 不会将您在 D5 渲染器中使用或生成的内容，用于训练、再训练或改进在 D5 渲染器之外提供的通用机器学习模型，也不会据此开发在 D5 渲染器之外单独提供的新产品或服务。

Without your express written consent, D5 will not use the Content that you use or generate in D5 Render to train, retrain, or improve general-purpose machine learning models provided outside D5 Render, nor will D5 use such Content to develop new products or services separately provided outside D5 Render.

2. 输入及输出内容及所有权 Input and Output Content and Ownership

当您使用 D5 渲染器中的 AI 功能（如 AI 生成 3D 模型、AI 生成 2D 图像等）时，您可能会向该等功能提交文本、图像、文件或其他内容，并基于该等输入获得 AI 生成的结果（“输出内容”）。输入内容和输出内容统称为本条中的“AI 内容”。

When you use AI features in D5 Render, such as AI-generated 3D models, AI-generated 2D images, and similar features, you may submit text, images, files, or other content to such features and obtain AI-generated results based on such inputs ("Output Content"). The input content and Output Content are collectively referred to as "AI Content" in this Section.

As between you and D5, and to the maximum extent permitted by law, you retain all rights in and to the input content lawfully provided by you and the Output Content generated based on such input content, subject to these Terms, the General Terms, applicable rules published by D5 or notified through in-product notices, and applicable laws and regulations. If D5 holds any rights in the Output Content for legal reasons, D5 hereby assigns to you such rights to the extent reasonably transferable.

3. D5 对 AI 内容的使用许可 License Granted to D5 for AI Content

为向您提供、维护和改进 D5 渲染器中的 AI 功能，并保证服务性能与质量，您在此授予 D5 一项在法律允许的最大范围内的、非排他、全球范围、免版税、已全额付清、可转让且可再许可（仅限 D5 关联公司、必要供应商）的许可，用于：

In order to provide, maintain, and improve the AI features in D5 Render and to ensure service performance and quality, you hereby grant D5, to the maximum extent permitted by law, a non-exclusive, worldwide, royalty-free, fully paid, transferable, and sublicensable license, sublicensable only to D5's affiliates and necessary suppliers, to:

（1）复制、存储、展示、分发、修改您的输入内容，仅限为向您提供相应 AI 功能、进行必要的性能监控和质量保证；

(1) copy, store, display, distribute, and modify your input content, solely for the purpose of providing the relevant AI features to you and conducting necessary performance monitoring and quality assurance;

（2）按实现渲染、预览、同步、AI 处理等目的，对输入内容/输出内容进行必要的格式转换、生成缩略图、提取特征等技术处理；

(2) perform necessary technical processing of the input content and/or Output Content for purposes such as rendering, previewing, synchronization, and AI processing, including format conversion, thumbnail generation, feature extraction, and similar processing; and

（3）在必要范围内向为 D5 提供底层 AI 能力的服务提供商传输输入内容/输出内容，该等服务提供商对相关内容的处理，受 D5 与该等服务提供商之间届时适用的合作协议、服务条款、数据处理条款、公开政策、技术措施及其他相关安排约束。D5将根据其实际知悉的、与D5接入和提供相关 AI 功能直接相关的服务条款、政策、合作安排或其他可获得的合规说明，采取合理商业措施选择、接入和管理相关服务提供商，并通过适用安排约定或确认其处理目的、处理范围及相关使用限制，以使其对相关内容的处理限于为 D5 提供相关 AI 功能、安全保障、故障排查、性能监控、质量保证及法律合规所合理必要的范围。根据 D5 目前接入相关 AI 服务时所了解的服务条款、政策或合作安排，相关服务提供商不应将通过 D5 AI 功能处理的输入内容/输出内容用于其自有模型训练、基础模型训练、营销、广告、公开展示、转售或与 D5 服务无关的独立用途。除法律法规另有规定或 D5 另有明确承诺外，D5不对该等服务提供商的服务、系统、政策、实际处理行为或持续可用性作出独立保证。

(3) transmit the input content and/or Output Content, to the extent necessary, to service providers that provide underlying AI capabilities to D5. The processing of relevant content by such service providers shall be subject to the cooperation agreements, service terms, data processing terms, public policies, technical measures, and other relevant arrangements then applicable between D5 and such service providers. D5 will take commercially reasonable measures to select, integrate, and manage the relevant service providers based on the service terms, policies, cooperation arrangements, or other available compliance descriptions actually known to D5 and directly related to D5's integration and provision of the relevant AI features, and will agree on or confirm, through applicable arrangements, their processing purposes, processing scope, and relevant use restrictions, so that their processing of the relevant content is limited to the scope reasonably necessary to provide the relevant AI features, security safeguards, troubleshooting, performance monitoring, quality assurance, and legal compliance for D5. Based on the service terms, policies, or cooperation arrangements currently known to D5 when integrating the relevant AI services, the relevant service providers should not use the input content and/or Output Content processed through D5 AI features for their own model training, foundation model training, marketing, advertising, public display, resale, or independent purposes unrelated to the D5 Services. Unless otherwise required by laws and regulations or expressly undertaken by D5, D5 does not make any independent warranty regarding such service providers' services, systems, policies, actual processing activities, or continued availability.

4. 为避免疑义，除非您另行以书面方式明确同意，D5 不会将您的输入内容或输出内容：

4. For the avoidance of doubt, unless you separately provide express written consent, D5 will not use your input content or Output Content:

（1）用于训练或改进 D5 以外的通用机器学习模型、基础模型或第三方自有模型；

(1) to train or improve general-purpose machine learning models, foundation models, or third-party proprietary models outside D5; or

（2）对外公开展示、披露或用于营销、宣传或基准测试目的。

(2) for external public display, disclosure, marketing, promotion, or benchmarking purposes.

对于底层 AI 服务提供商对相关内容的处理，适用本条第3款第（3）项及本专项条款第8.7款的约定。

The processing of relevant content by underlying AI service providers shall be subject to Section 3(3) of this Section and Section 8.7 of these Special Terms.

5. 您声明并保证，您对所提供的输入内容拥有或已合法取得所有必要权利和授权，包括但不限于著作权、署名权、肖像权、隐私权及其他相关权利。您不得在输入内容中提交您无权提交、处理或授权D5及其服务提供商处理的个人信息、敏感个人信息、未公开商业秘密、保密信息、国家秘密、工作秘密、受出口管制或制裁限制的信息，或任何可能侵犯第三方知识产权、肖像权、名誉权、隐私权、个人信息权益、商业秘密或其他合法权益的内容。若输入内容包含第三方个人信息、肖像、声音、作品、商标、商业标识、设计、模型、图纸、素材或其他受保护内容，您应确保已取得合法、充分且可覆盖您使用D5相关AI功能及使用输出内容的授权、同意或许可。

5. You represent and warrant that you own or have lawfully obtained all necessary rights and authorizations in and to the input content you provide, including without limitation copyright, attribution rights, portrait rights, privacy rights, and other related rights. You shall not submit in the input content any personal information, sensitive personal information, undisclosed trade secrets, Confidential Information, state secrets, work secrets, information subject to export controls or sanctions restrictions, or any content that may infringe any third party's intellectual property rights, portrait rights, reputation rights, privacy rights, personal information rights and interests, trade secrets, or other lawful rights and interests, where you do not have the right to submit, process, or authorize D5 and its service providers to process such content. If the input content contains any third-party personal information, portrait, voice, work, trademark, commercial identifier, design, model, drawing, asset, or other protected content, you shall ensure that you have obtained lawful and sufficient authorization, consent, or permission covering your use of the relevant D5 AI features and your use of the Output Content.

6. 相似内容提示 Notice on Similar Content

由于人工智能技术的通用特性，AI 输出可能不具有唯一性，其他用户在输入相似或不同的指令时，也可能得到在形式或表达上类似的输出。该等情形并不表示 D5 向其他用户披露了您的具体输入内容或输出内容，亦不构成对您内容权利的侵害。D5 不会在不同用户之间共享具体的输入内容/输出内容。

Due to the general nature of artificial intelligence technology, AI outputs may not be unique, and other users may obtain outputs that are similar in form or expression when entering similar or different prompts. Such circumstances do not indicate that D5 has disclosed your specific input content or Output Content to other users, nor do they constitute an infringement of your rights in your Content. D5 will not share specific input content and/or Output Content between different users.

7. 准确性与依赖责任 Accuracy and Reliance Responsibility

在不限制通用条款下免责声明的前提下，您理解并同意：

Without limiting the disclaimers under the General Terms, you understand and agree that:

（1）AI 功能的输出可能不准确、不完整、存在偏差或与事实不符，不应作为您做出专业判断或重大决策的唯一依据；

(1) outputs from AI features may be inaccurate, incomplete, biased, or inconsistent with facts, and should not be used as the sole basis for your professional judgment or material decisions;

（2）您应对 AI 输出进行独立审查和必要的人工复核，并确保您对输出的使用不违反法律法规及本条款约定；

(2) you shall independently review and conduct necessary human review of AI outputs, and ensure that your use of the outputs does not violate laws and regulations or these Terms; and

（3）因您依赖 AI 输出而作出的任何决策或采取的行动所产生的后果，由您自行承担，D5 不就此向您或任何第三方承担责任。

(3) you shall be solely responsible for the consequences of any decisions made or actions taken in reliance on AI outputs, and D5 shall not be liable to you or any third party in this regard.

8. AI 功能使用规范 AI Feature Use Rules

8.1 为确保AI功能的合法、安全和负责任使用，您在使用D5渲染器的AI功能（包括但不限于AI生成3D模型、AI生成2D图像、Text to 3D、Image to 3D以及D5不时提供的其他人工智能相关功能，以下统称"AI功能"）时，除遵守通用条款和本专项条款的其他规定外，还应遵守本条所列的使用规范。

8.1 To ensure the lawful, secure, and responsible use of AI features, when using the AI features of D5 Render, including without limitation AI-generated 3D models, AI-generated 2D images, Text to 3D, Image to 3D, and other artificial intelligence-related features provided by D5 from time to time, collectively, "AI Features", you shall comply with the use rules set out in this Section in addition to the other provisions of the General Terms and these Special Terms.

D5可能基于自研能力、关联方能力或第三方服务提供商提供的人工智能模型、云计算、内容处理或其他底层技术能力向您提供AI功能。D5将结合相关功能的性质，在本专项条款、通用条款、隐私政策、第三方许可说明、产品页面或产品内提示中，说明与用户正常使用AI功能直接相关的主要使用规则、数据处理规则或使用限制。如D5明确提示某项第三方条款、许可、内容政策或使用限制适用于特定功能、内容、数据或输出结果的，您仍应在该等适用范围内予以遵守。D5对第三方条款、许可、政策或限制的说明不应理解为D5对该等第三方条款、许可、政策或限制的完整转述，亦不构成D5代表第三方服务提供商作出的承诺、保证或授权。

D5 may provide AI Features to you based on self-developed capabilities, capabilities of its affiliates, or artificial intelligence models, cloud computing, content processing, or other underlying technical capabilities provided by third-party service providers. D5 will, based on the nature of the relevant features, describe in these Special Terms, the General Terms, the Privacy Policy, third-party license notices, product pages, or in-product notices the main rules of use, data-processing rules, or use restrictions directly related to users' normal use of AI Features. If D5 expressly states that certain third-party terms, licenses, content policies, or use restrictions apply to a specific feature, content, data, or output, you shall also comply with them within the applicable scope. D5's description of any third-party terms, licenses, policies, or restrictions shall not be understood as a complete restatement of such third-party terms, licenses, policies, or restrictions, nor shall it constitute any undertaking, warranty, or authorization made by D5 on behalf of any third-party service provider.

8.2 您不得使用AI功能生成、上传、输入、处理、编辑、传播、发布、分享、下载、保存或以其他方式使用以下类型的内容：

8.2 You shall not use AI Features to generate, upload, input, process, edit, transmit, publish, share, download, save, or otherwise use any of the following types of content:

（1）违反宪法所确定的基本原则，危害国家安全、泄露国家秘密、颠覆国家政权、破坏国家统一，损害国家荣誉和利益，或者违反适用法律法规的内容；

(1) content that violates the fundamental principles established by the Constitution, endangers national security, divulges state secrets, subverts state power, undermines national unity, harms the honor or interests of the State, or violates applicable laws and regulations;

（2）色情、淫秽、低俗、露骨性内容、性剥削内容或其他违反公序良俗的内容；

(2) pornographic, obscene, vulgar, sexually explicit, sexually exploitative, or other content that violates public order and good morals;

（3）涉及未成年人的不当内容，包括但不限于未成年人裸露、性暗示、性剥削、诱导未成年人从事不当行为，或以不当方式呈现未成年人形象的内容；

(3) inappropriate content involving minors, including without limitation nudity of minors, sexual innuendo involving minors, sexual exploitation of minors, inducement of minors to engage in inappropriate conduct, or content depicting minors in an inappropriate manner;

（4）基于种族、民族、国籍、宗教、性别、年龄、残疾、性取向、疾病、社会身份或其他受保护特征，对特定个人或群体进行歧视、贬损、侮辱、骚扰、威胁，或煽动仇恨、敌意、暴力的内容；

(4) content that discriminates against, degrades, insults, harasses, or threatens specific individuals or groups, or incites hatred, hostility, or violence, based on race, ethnicity, nationality, religion, gender, age, disability, sexual orientation, disease, social identity, or other protected characteristics;

（5）针对可识别个人、特定群体或真实地点的暴力描写、威胁、恐吓，或者宣扬、煽动、指导、协助现实世界暴力行为的内容；

(5) depictions of violence, threats, or intimidation targeting identifiable individuals, specific groups, or real locations, or content that promotes, incites, instructs, or assists real-world violent conduct;

（6）涉及违法犯罪活动、违禁品、受管制物品、危险物品、规避执法、逃避监管、网络攻击、恶意代码、钓鱼欺诈、身份冒用、非法获取数据或其他违法不当行为的内容；

(6) content involving illegal or criminal activities, contraband, controlled items, dangerous items, evasion of law enforcement, avoidance of regulation, cyberattacks, malicious code, phishing, identity impersonation, illegal acquisition of data, or other illegal or improper conduct;

（7）宣扬、鼓励、指导或美化自残、自杀、饮食障碍、药物滥用或其他可能造成个人身心伤害行为的内容；

(7) content that promotes, encourages, instructs, or glorifies self-harm, suicide, eating disorders, drug abuse, or other conduct that may cause personal physical or mental harm;

（8）宣扬恐怖主义、极端主义、暴力极端思想，或为恐怖主义、极端主义、暴力犯罪活动提供支持、宣传、招募、筹资、指导或便利的内容；

(8) content that promotes terrorism, extremism, or violent extremist ideology, or provides support, publicity, recruitment, fundraising, instruction, or facilitation for terrorism, extremism, or violent criminal activities;

（9）可能导致现实世界伤害的虚假、误导性、欺诈性或欺骗性内容，包括但不限于冒充他人、伪造身份、伪造官方文件、伪造证据、误导公众、实施诈骗或操纵他人行为的内容；

(9) false, misleading, fraudulent, or deceptive content that may cause real-world harm, including without limitation content that impersonates others, fabricates identities, forges official documents, fabricates evidence, misleads the public, commits fraud, or manipulates the conduct of others;

（10）未经授权披露、处理或生成他人个人信息、敏感个人信息、隐私信息、肖像、声音、通信内容、位置信息、身份凭证，或组织的商业秘密、保密信息、未公开信息的内容；

(10) content that discloses, processes, or generates another person's personal information, sensitive personal information, private information, portrait, voice, communications, location information, identity credentials, or an organization's trade secrets, Confidential Information, or non-public information without authorization;

（11）蓄意生成、上传、处理或使用侵犯第三方著作权、商标权、专利权、商业秘密、肖像权、姓名权、名誉权、隐私权、个人信息权益或其他合法权益的内容；

(11) content that is intentionally generated, uploaded, processed, or used to infringe any third party's copyright, trademark rights, patent rights, trade secrets, portrait rights, name rights, reputation rights, privacy rights, personal information rights and interests, or other lawful rights and interests; or

（12）违反D5公示的内容规则、社区规则、产品内提示、第三方许可说明或适用法律法规的其他内容。

(12) any other content that violates content rules, community rules, in-product notices, third-party license notices published by D5, or applicable laws and regulations.

8.3 在使用AI功能时，您应确保您输入、上传、提交或提供的文本提示、参考图片、模型文件、场景文件、材质、贴图、音视频、数据、说明信息或其他内容均来源合法，并且您已取得使用该等内容以及授权D5及其服务提供商为提供AI功能而处理该等内容所需的全部权利、许可、授权或同意。

8.3 When using AI Features, you shall ensure that the text prompts, reference images, model files, scene files, materials, textures, audio and video, data, descriptive information, or other content that you input, upload, submit, or provide are lawfully sourced, and that you have obtained all rights, permissions, authorizations, or consents necessary to use such content and to authorize D5 and its service providers to process such content for the purpose of providing AI Features.

未经合法授权或除非相关功能明确支持且您已依法取得必要同意，您不得在输入内容中包含以下信息或内容：

Without lawful authorization, or unless the relevant feature expressly supports such use and you have obtained necessary consent in accordance with law, you shall not include the following information or content in the input content:

（1）个人身份信息、敏感个人信息或其他可能识别特定自然人的信息，包括但不限于身份证件号码、护照号码、社会保险号码、银行账户信息、支付账户信息、生物识别信息、精确定位信息、医疗健康信息、未成年人个人信息、私人联系方式或其他敏感信息；

(1) personal identity information, sensitive personal information, or other information that may identify a specific natural person, including without limitation identity document numbers, passport numbers, social insurance numbers, bank account information, payment account information, biometric information, precise location information, medical and health information, personal information of minors, private contact information, or other sensitive information;

（2）您不拥有或未获得合法授权使用的受著作权、商标权、专利权、商业秘密、肖像权、姓名权、名誉权、隐私权、个人信息权益或其他权利保护的第三方内容；

(2) third-party content protected by copyright, trademark rights, patent rights, trade secrets, portrait rights, name rights, reputation rights, privacy rights, personal information rights and interests, or other rights, where you do not own such content or have not obtained lawful authorization to use it;

（3）国家秘密、工作秘密、商业秘密、保密信息、未公开商业信息、受出口管制或制裁限制的信息，或您无权提交、上传、处理或授权D5及其服务提供商处理的其他信息；

(3) state secrets, work secrets, trade secrets, Confidential Information, non-public business information, information subject to export controls or sanctions restrictions, or other information that you have no right to submit, upload, process, or authorize D5 and its service providers to process; or

（4）可能违反法律法规、本专项条款、通用条款、隐私政策、产品内提示或D5公示规则的其他内容。

(4) any other content that may violate laws and regulations, these Special Terms, the General Terms, the Privacy Policy, in-product notices, or rules published by D5.

8.4 竞争性使用限制 Restrictions on Competitive Use

除非D5另行书面许可，您不得将AI功能、AI功能的输入内容、输出内容、交互结果、接口返回结果或相关技术信息用于以下目的：

Unless otherwise permitted by D5 in writing, you shall not use the AI Features, input content, Output Content, interaction results, interface return results, or related technical information of the AI Features for any of the following purposes:

（1）训练、开发、微调、验证、测试、评估、改进、替代或优化与D5、D5渲染器、D5 AI功能相同、类似或具有竞争关系的人工智能模型、算法、系统、产品或服务；

(1) training, developing, fine-tuning, validating, testing, evaluating, improving, replacing, or optimizing any artificial intelligence model, algorithm, system, product, or service that is identical or similar to, or competes with, D5, D5 Render, or D5 AI Features;

（2）通过提示词工程、自动化请求、批量测试、模型抽取、数据抓取、逆向工程、反编译、反汇编、规避技术措施或其他方式，识别、提取、推断、还原或复制AI功能的底层模型、算法、系统提示词、训练数据、安全机制、技术组件或其他非公开技术信息；

(2) identifying, extracting, inferring, restoring, or copying the underlying models, algorithms, system prompts, training data, security mechanisms, technical components, or other non-public technical information of the AI Features through prompt engineering, automated requests, bulk testing, model extraction, data scraping, reverse engineering, decompilation, disassembly, circumvention of technical measures, or other means;

（3）开发、提供、推广或商业化与D5渲染器、D5 AI功能或D5底层AI服务提供商的相关产品、模型或服务具有实质竞争关系的产品或服务；

(3) developing, providing, promoting, or commercializing products or services that materially compete with D5 Render, D5 AI Features, or relevant products, models, or services of D5's underlying AI service providers; or

（4）绕过D5的技术限制、计费规则、访问控制、安全措施、内容审核机制、调用频率限制或其他产品管理措施。

(4) bypassing D5's technical restrictions, charging rules, access controls, security measures, content review mechanisms, call frequency limits, or other product management measures.

如D5已公示或提示某项第三方限制适用于特定AI功能、内容、数据或输出结果的，您还应在该等适用范围内遵守相关限制。

If D5 has published or notified that a certain third-party restriction applies to a specific AI feature, content, data, or output, you shall also comply with the relevant restriction within the applicable scope.

8.5 特定用途限制 Restrictions on Specific Uses

您不得将AI功能或其输出内容用于以下特定场景：

You shall not use AI Features or their Output Content in any of the following specific scenarios:

（1）临床医疗实践、医疗诊断、医疗建议、药物使用建议、心理危机干预，或其他可能影响个人生命、身体健康或医疗权益的用途；

(1) clinical medical practice, medical diagnosis, medical advice, medication advice, psychological crisis intervention, or other purposes that may affect an individual's life, physical health, or medical rights and interests;

（2）作为作出法律、金融、税务、投资、保险、工程、安全、就业、教育、住房、信贷、社会福利、政府服务或其他专业判断、资格认定、重大权益决定的唯一依据；

(2) as the sole basis for making legal, financial, tax, investment, insurance, engineering, safety, employment, education, housing, credit, social welfare, government service, or other professional judgments, qualification determinations, or material rights-and-interests decisions;

（3）用于控制、操作或影响关键基础设施、交通运输、能源、公共安全、执法、武器、军事、核设施、航空航天、应急救援或其他可能危害公共安全、国家安全、社会公共利益或重大人身财产安全的场景；

(3) for controlling, operating, or affecting critical infrastructure, transportation, energy, public safety, law enforcement, weapons, military affairs, nuclear facilities, aviation and aerospace, emergency rescue, or other scenarios that may endanger public safety, national security, public interests, or major personal or property safety;

（4）用于对自然人进行完全自动化决策、画像、评分、筛选、监控、识别或追踪，并对其合法权益产生重大影响，除非您已依法取得充分授权、完成必要评估、提供必要说明并进行充分人工复核；

(4) for fully automated decision-making, profiling, scoring, screening, monitoring, identification, or tracking of natural persons that has a material impact on their lawful rights and interests, unless you have lawfully obtained sufficient authorization, completed necessary assessments, provided necessary explanations, and conducted sufficient human review; or

（5）任何违反中华人民共和国法律法规、适用当地法律法规、监管要求、本专项条款、通用条款、隐私政策、D5公示规则或产品内提示的用途。

(5) any purpose that violates the laws and regulations of the People's Republic of China, applicable local laws and regulations, regulatory requirements, these Special Terms, the General Terms, the Privacy Policy, rules published by D5, or in-product notices.

8.6 AI功能的输出内容可能存在不准确、不完整、不适当、不符合您预期、与第三方内容相似或不满足特定用途要求的情况。D5不保证AI输出内容的准确性、完整性、唯一性、非侵权性、适销性、适用于特定用途或一定能够满足您的使用目的。

8.6 The Output Content of AI Features may be inaccurate, incomplete, inappropriate, inconsistent with your expectations, similar to third-party content, or unsuitable for a specific purpose. D5 does not guarantee the accuracy, completeness, uniqueness, non-infringement, merchantability, fitness for a particular purpose, or ability to meet your intended use of AI Output Content.

您应根据具体使用场景，对AI输出内容进行必要的人工审核、修改、验证和权利清查，并自行判断其是否适合用于相应用途。您对输入内容、输出内容及其后续使用承担责任，包括但不限于确保相关使用不违反法律法规、不侵犯第三方合法权益、不违反本专项条款、通用条款、隐私政策、产品内提示或其他适用规则。

You shall conduct necessary human review, modification, verification, and rights clearance of AI Output Content based on the specific use scenario, and independently determine whether it is suitable for the relevant purpose. You are responsible for the input content, Output Content, and their subsequent use, including without limitation ensuring that such use does not violate laws and regulations, infringe upon any third party's lawful rights and interests, or violate these Special Terms, the General Terms, the Privacy Policy, in-product notices, or other applicable rules.

8.7 AI内容处理及模型训练 AI Content Processing and Model Training

为提供AI功能，D5可能在必要范围内处理您的输入内容、输出内容、生成参数、任务状态、错误日志及相关技术信息，并可能在必要范围内委托为D5提供底层AI能力、云计算、存储、安全或内容处理能力的服务提供商处理前述信息。

In order to provide AI Features, D5 may process, to the extent necessary, your input content, Output Content, generation parameters, task status, error logs, and related technical information, and may, to the extent necessary, entrust service providers that provide underlying AI capabilities, cloud computing, storage, security, or content processing capabilities to D5 to process the foregoing information.

该等服务提供商对相关信息的处理，受D5与该等服务提供商之间届时适用的合作协议、服务条款、数据处理条款、公开政策、技术措施及其他相关安排约束。D5将根据其实际知悉的、与D5接入和提供相关AI功能直接相关的服务条款、政策、合作安排或其他可获得的合规说明，采取合理商业措施选择、接入和管理相关服务提供商，并要求其仅在为D5提供相关AI功能、安全保障、故障排查、性能监控、质量保证及法律合规所必要的范围内处理相关信息。

The processing of relevant information by such service providers shall be subject to the cooperation agreements, service terms, data processing terms, public policies, technical measures, and other relevant arrangements then applicable between D5 and such service providers. D5 will take commercially reasonable measures to select, integrate, and manage the relevant service providers based on the service terms, policies, cooperation arrangements, or other available compliance descriptions actually known to D5 and directly related to D5's integration and provision of the relevant AI Features, and will require them to process the relevant information only to the extent necessary to provide the relevant AI Features, security safeguards, troubleshooting, performance monitoring, quality assurance, and legal compliance for D5.

除非取得您的明确授权或法律法规另有规定，D5不会将您的输入内容或输出内容用于D5之外的通用机器学习模型、基础模型或第三方自有模型训练；根据D5目前接入相关AI服务时所了解的服务条款、政策或合作安排，相关服务提供商不应将通过D5 AI功能处理的用户输入内容或输出内容用于其自有模型训练、基础模型训练、营销、广告、公开展示、转售或与D5服务无关的独立用途。如相关服务提供商的服务条款、政策、合作安排或服务能力发生变化，D5可根据本专项条款、通用条款、隐私政策、产品提示或适用法律法规要求更新相关说明、调整相关AI功能或采取其他合理措施。除法律法规另有规定或D5另有明确承诺外，D5不对第三方服务提供商的服务、系统、政策、实际处理行为或持续可用性作出独立保证。

Unless your express authorization has been obtained or otherwise provided by laws and regulations, D5 will not use your input content or Output Content to train general-purpose machine learning models, foundation models, or third-party proprietary models outside D5. Based on the service terms, policies, or cooperation arrangements currently known to D5 when integrating the relevant AI services, the relevant service providers should not use user input content or Output Content processed through D5 AI Features for their own model training, foundation model training, marketing, advertising, public display, resale, or independent purposes unrelated to the D5 Services. If the service terms, policies, cooperation arrangements, or service capabilities of the relevant service providers change, D5 may update the relevant descriptions, adjust the relevant AI Features, or take other reasonable measures in accordance with these Special Terms, the General Terms, the Privacy Policy, product notices, or applicable laws and regulations. Unless otherwise required by laws and regulations or expressly undertaken by D5, D5 does not make any independent warranty regarding any third-party service provider's services, systems, policies, actual processing activities, or continued availability.

8.8 违规后果 Consequences of Violations

如D5发现或有合理理由认为您违反本条所列使用规范的，D5有权视情节严重程度，采取以下一项或多项措施：

If D5 discovers or has reasonable grounds to believe that you have violated the use rules set out in this Section, D5 shall have the right, depending on the severity of the circumstances, to take one or more of the following measures:

（1）向您发出警告并要求限期整改；

(1) issue a warning to you and require rectification within a specified period;

（2）暂停或限制您使用AI功能的权限；

(2) suspend or restrict your permission to use AI Features;

（3）删除违规内容；

(3) delete non-compliant content;

（4）终止向您提供D5渲染器服务；

(4) terminate the provision of D5 Render Services to you; and/or

（5）依据通用条款及本专项条款的其他规定追究您的相应责任。

(5) pursue your corresponding liability in accordance with the General Terms and other provisions of these Special Terms.

9. 数据保护与保留期限 Data Protection and Retention Period

D5 对您在使用 D5 渲染器（包括 AI 功能）过程中产生的个人数据的处理，将遵守适用法律法规以及 D5 公示的《隐私政策》。在实现相应功能、遵守法律要求或解决争议所必需的期限届满后，D5 将删除或对您的输入内容/输出内容进行去标识化处理。法律允许的范围内，您可通过 D5 公示的联系方式提出删除请求，D5 将根据法律规定处理。

D5's processing of personal data generated during your use of D5 Render, including AI Features, will comply with applicable laws and regulations and the Privacy Policy published by D5. After the period necessary to implement the relevant features, comply with legal requirements, or resolve disputes expires, D5 will delete or de-identify your input content and/or Output Content. To the extent permitted by law, you may submit a deletion request through the contact information published by D5, and D5 will process such request in accordance with law.

五、第三方软件及知识产权声明 Third-Party Software and Intellectual Property Notices

1. 概述 Overview

本软件及相关服务中可能包含或集成由第三方提供的软件、引擎、框架、库、工具或其他组件（以下统称"第三方组件"），也可能调用由第三方提供的人工智能模型、云计算、内容处理或其他技术服务（以下统称"第三方服务"）。第三方组件及第三方服务合称"第三方组件及服务"。相关第三方组件及服务的知识产权及其他权利归其各自权利人所有。

This software and the related Services may contain or integrate software, engines, frameworks, libraries, tools, or other components provided by third parties, collectively, "Third-Party Components", and may also invoke artificial intelligence models, cloud computing, content processing, or other technical services provided by third parties, collectively, "Third-Party Services". Third-Party Components and Third-Party Services are collectively referred to as "Third-Party Components and Services". The intellectual property rights and other rights in and to the relevant Third-Party Components and Services are owned by their respective rights holders.

有关第三方组件及服务的名称、权利声明及适用的许可条款等信息，D5 将通过官方网站或其他合理方式进行披露，用户可自行查阅（如 https://www.d5render.cn/third-party-license/）。如相关第三方组件适用独立的许可条款，在不违反中华人民共和国法律法规的前提下，且在该等许可条款依法适用于相关第三方软件的范围内，该等许可条款仅对相应第三方软件部分适用。除前述依法适用的情形外，本协议的其他约定不因此受到影响。

D5 will disclose information regarding the names, rights notices, applicable license terms, and other information of the relevant Third-Party Components and Services through its official website or other reasonable means, and users may review such information by themselves, such as https://www.d5render.cn/third-party-license/ . If separate license terms apply to the relevant Third-Party Components, then, provided that such application does not violate the laws and regulations of the People's Republic of China, and to the extent such license terms lawfully apply to the relevant third-party software, such license terms shall apply only to the corresponding third-party software portion. Except for the foregoing legally applicable circumstances, the other provisions of this Agreement shall not be affected thereby.

除非另有明确约定，第三方组件及服务并非由 D5 开发、控制或保证，D5 不对第三方组件及服务的功能、性能、安全性或适用性作出任何明示或暗示的保证。

Unless expressly agreed otherwise, the Third-Party Components and Services are not developed, controlled, or warranted by D5, and D5 makes no express or implied warranty regarding the functions, performance, security, or fitness of the Third-Party Components and Services.

2. Krpano组件 Krpano Component

（1）D5渲染器中集成了由第三方（krpano GmbH）授权的全景展示组件（krpano viewer）。当您使用相关全景功能时，除遵守本专项条款外，还必须遵守 krpano 的许可条款。

(1) D5 Render integrates a panoramic display component, the krpano viewer, licensed by a third party, krpano GmbH. When you use the relevant panoramic features, you must comply with the krpano license terms in addition to these Special Terms.

（2）您仅可将经 D5渲染器生成的全景文件用于个人或商业展示，但不得：

(2) You may use panoramic files generated through D5 Render only for personal or commercial display, but you shall not:

未经授权下载并自行托管 krpano viewer 文件；
download and self-host krpano viewer files without authorization;
移除或隐藏 krpano 或 D5 的标识、界面元素；
remove or conceal any krpano or D5 logos, marks, or interface elements;
修改、反编译、转授权或再分发 krpano 组件；
modify, decompile, sublicense, or redistribute the krpano component; or
将 krpano viewer 用于独立的平台或服务运营。
use the krpano viewer for the operation of an independent platform or service.

（3）全景图像文件（如渲染生成的 JPG/PNG）在不违反第三方许可前提下归您所有，您可自由保存、编辑或另行使用。但如需通过 krpano viewer 展示，仍受本条款约束。

(3) Panoramic image files, such as JPG/PNG files generated by rendering, are owned by you, provided that no third-party license is violated, and you may freely save, edit, or otherwise use them. However, if they are displayed through the krpano viewer, they shall remain subject to this Section.

如您在使用 D5渲染器时涉及其他第三方软件（如 3ds Max、Revit、SketchUp 等）或其插件、SDK、文件格式等，您应遵守相应第三方的软件许可条款和法律义务。D5 不对您与该等第三方之间的法律关系及由此产生的纠纷承担责任。

If your use of D5 Render involves other third-party software, such as 3ds Max, Revit, SketchUp, and similar software, or their plug-ins, SDKs, file formats, or similar materials, you shall comply with the corresponding third-party software license terms and legal obligations. D5 shall not be liable for the legal relationship between you and such third parties or for any disputes arising therefrom.

对于 D5 渲染器中由 D5 作为产品功能向用户提供的内置 AI 功能，如涉及调用第三方人工智能、云计算或内容处理能力的，D5 将结合相关功能的性质及D5实际知悉且与D5向用户提供相关功能直接相关的第三方要求，在本协议、通用条款、隐私政策、第三方许可说明、产品页面或产品内提示中说明与用户正常使用该等功能直接相关的主要使用规则、数据处理规则或使用限制。如 D5 明确提示某项第三方条款、政策或限制适用于特定功能、内容或输出结果的，用户仍应在该等适用范围内予以遵守。D5对第三方条款、许可、政策或限制的说明不应理解为D5对该等第三方条款、许可、政策或限制的完整转述，亦不构成D5代表第三方服务提供商作出的承诺、保证或授权。

For built-in AI features provided by D5 to users as product features in D5 Render, where such features involve the invocation of third-party artificial intelligence, cloud computing, or content processing capabilities, D5 will, based on the nature of the relevant feature and the third-party requirements actually known to D5 and directly related to D5's provision of the relevant feature to users, describe in this Agreement, the General Terms, the Privacy Policy, third-party license notices, product pages, or in-product notices the main rules of use, data-processing rules, or use restrictions directly related to users' normal use of such features. If D5 expressly states that certain third-party terms, policies, or restrictions apply to a specific feature, content, or output, users shall also comply with them within the applicable scope. D5's description of any third-party terms, licenses, policies, or restrictions shall not be understood as a complete restatement of such third-party terms, licenses, policies, or restrictions, nor shall it constitute any undertaking, warranty, or authorization made by D5 on behalf of any third-party service provider.

六、版本类型与用途限制 Version Types and Use Restrictions

1. 若您使用的是 D5渲染器学生版、高校版、实验室版、试用版或其他特殊版本，除本专项条款外，还应遵守该版本适用的专门条款（如学生版许可条款、试用政策等）。

1. If you use the Student, University, Lab, Trial, or any other special version of D5 Render, you shall comply with the special terms applicable to such version, such as student license terms, trial policies, and similar terms, in addition to these Special Terms.

2. 如专门条款对使用范围、设备绑定、是否可商用等另有限制的，以专门条款为准。超出该等限制的使用行为，构成对本专项条款及专门条款的双重违约，D5 有权依据通用条款和本专项条款采取包括但不限于暂停、终止服务在内的措施。

2. If the special terms impose separate restrictions on the scope of use, device binding, commercial use, or similar matters, such special terms shall prevail. Any use beyond such restrictions shall constitute a breach of both these Special Terms and the special terms, and D5 shall have the right to take measures in accordance with the General Terms and these Special Terms, including without limitation suspending or terminating the Services.

七、与通用条款的关系 Relationship with the General Terms

1. 本专项条款未作约定的事项，适用《D5服务通用条款》。

1. Matters not covered by these Special Terms shall be governed by the D5 General Terms of Service.

2. 就D5渲染器软件的使用而言，如本专项条款与通用条款存在不一致或冲突，以本专项条款为准。

2. With respect to the use of the D5 Render software, in the event of any inconsistency or conflict between these Special Terms and the General Terms, these Special Terms shall prevail.

3. 本专项条款以中文书就，英文版本仅为阅读便利之目的提供。英文版本不应被视为对中文版本的修改、补充、解释或替代。如中文版本与英文版本存在任何不一致、歧义或冲突，均应以中文版本为准。

3. These Special Terms are prepared in Chinese, and the English version is provided for convenience of reference only. The English version shall not be deemed to amend, supplement, interpret, or replace the Chinese version. In the event of any inconsistency, ambiguity, or conflict between the Chinese version and the English version, the Chinese version shall prevail.
